Rental Agreement

The per-ride contract between you and Skootor. Activates each time you unlock a scooter.

1. Parties

This Rental Agreement ("Agreement") is between Skootor Holdings (Aust) Pty Ltd (ABN 18 635 623 004) ("Owner", "we", "us") and the person who unlocks a Skootor scooter via our service ("Renter","you").

This Agreement is supplementary to our Terms of Service and Privacy Policy. Where this Agreement conflicts with the Terms of Service, this Agreement prevails for matters relating to a specific rental.

2. The vehicle

The vehicle ("Scooter") is the road-registered 125 cc motor scooter identified in the rider app when you start the ride, together with the helmet stored under the seat and any other on-board equipment.

You agree to inspect the Scooter and helmet at the start of the rental and to report any damage, missing items, or mechanical concern via the in-app help before you ride. Starting the ride is your confirmation that the Scooter appears in safe, rideable condition and that the helmet fits and is undamaged.

3. Term & rate

The rental period begins when you tap Unlockin the rider app and ends when you tap End ride. The minimum charge is the tier rate selected at unlock — Daily ($30), Weekly ($80), or Monthly ($250). Rates are in AUD and inclusive of GST.

The rental window is:

  • Daily: up to 24 hours from unlock.
  • Weekly: up to 7 days from unlock.
  • Monthly: up to 30 days from unlock.

If you keep the Scooter past the end of your window without extending, a late-return fee applies (see clause 6).

4. Rider obligations

You agree:

  • To hold a current NSW motorcycle licence — Class R (full) or R-Date (LAMS-restricted) — or, for international riders, an equivalent overseas motorcycle licence accompanied by a valid International Driving Permit (IDP). At least 18 years of age.
  • To be the sole rider — no passengers, no swapping mid-ride.
  • To wear the supplied helmet at all times while riding, with the chin strap fastened.
  • To obey all NSW road rules, including speed limits, traffic signals, and parking restrictions.
  • Not to ride under the influence of alcohol or drugs. NSW law sets zero BAC for Learner (L), P1, and P2 motorcycle riders by licence class. Skootor extends this requirement to every Renter regardless of licence class — zero BAC at all times during the rental.
  • Not to ride on highways, motorways, or roads with a posted speed limit above 80 km/h. Not to take the Scooter off-road, on beaches, or onto private property without permission.
  • To park only in legal on-street parking bays inside a Skootor return zone (visible on the map) when ending the ride.
  • Not to leave the Scooter unsecured. End the ride (which arms the immobiliser and alarm) before walking away — even for a few minutes.
  • To return the Scooter in the condition you received it, ordinary wear and tear excepted.
  • To report any incident — crash, mechanical fault, theft, damage, or interaction with police — immediately via the in-app help.
  • To not modify, tamper with, or attempt to bypass the GPS tracker, immobiliser, alarm, or any other on-board hardware.

5. Insurance & excess

The Scooter is covered by:

  • NSW Compulsory Third-Party (CTP) insurance — covers third-party personal-injury claims as required by NSW law.
  • Comprehensive fleet policy ([insurer name TBA]) — covers damage to third-party property and to the Scooter itself.

Standard excess:for damage caused during your rental, your liability is capped at AUD $[1,000] per incident, provided you have complied with this Agreement and the Terms of Service.

No-cover events: the comprehensive policy does not cover, and you are fully liable for, damage or loss caused by:

  • Riding under the influence of alcohol or drugs.
  • Riding without a valid licence (including expired, suspended, or disqualified).
  • Allowing an unauthorised person to ride the Scooter.
  • Carrying a passenger.
  • Using the Scooter on a highway, motorway, or speed-restricted area.
  • Wilful or reckless damage.
  • Failing to wear the supplied helmet.
  • Theft caused by your failure to End the ride (which arms the alarm and immobiliser) when not actively riding.
  • Use for any illegal purpose.

6. Fees

Beyond the tier rate, the following fees may apply:

All fees are in AUD and inclusive of GST. Fees are charged to your saved payment method. We'll send an itemised receipt for any post-ride charges.

7. Theft, loss & accident

Theft:if the Scooter is stolen during your rental, contact us immediately via the in-app help. If theft occurred while you were complying with this Agreement (you had ended the ride so the alarm and immobiliser were armed, you hadn't shared access to your account, etc.), your liability is capped at the standard excess. If you failed to End the ride before walking away, you are fully liable for the replacement cost of the Scooter (approx. AUD $[3,000–5,500] depending on model — SYM Orbit II 125 at the low end, Honda PCX 125 at the high end — plus on-board GPS / immobiliser hardware).

Accident: in the event of a crash, call triple-zero if anyone is injured, move to safety if you can, and report the accident via the in-app help. You agree to cooperate with our insurer's investigation. Do not admit liability or make statements about the accident to other parties before talking to us.

Mechanical breakdown: if the Scooter becomes unrideable through a fault that wasn't your responsibility, end the ride safely, report it, and we'll arrange recovery at no charge to you.

8. Termination

We may terminate this rental immediately if you breach this Agreement, the Terms of Service, or applicable law, or if we reasonably believe doing so is necessary for safety. On termination we may activate the engine immobiliser and you must return the Scooter to the nearest return zone. Fees for the rental and any applicable damages remain payable.

9. Acknowledgement

By tapping Unlock on a Skootor, you confirm that you:

  • Have read and accepted this Rental Agreement.
  • Hold a current valid motorcycle licence.
  • Are at least 18 years old.
  • Are not under the influence of alcohol or drugs.
  • Have inspected the Scooter and helmet and they appear safe.
