Terms of Service
The agreement between you and Skootor for using our service.
1. Introduction & acceptance
These Terms of Service ("Terms") govern your use of the Skootor website at skootor.com, our rider web app, and any of our scooters (collectively, the "Service"). The Service is operated by Skootor Holdings (Aust) Pty Ltd (ABN 18 635 623 004) ("Skootor","we", or "us").
By creating an account, scanning a Skootor QR code, or otherwise using the Service, you accept these Terms, our Privacy Policy, and (each time you rent a scooter) our Rental Agreement. If you don't accept them, you cannot use the Service.
2. Who can use Skootor
You may use the Service only if you:
- Are at least 18 years old.
- Hold a current and valid NSW motorcycle licence — Class R (full) or R-Date (LAMS-restricted, which permits riding a 125 cc step-through) — or, for international riders, an equivalent overseas motorcycle licence accompanied by a valid International Driving Permit (IDP).
- Are physically and mentally fit to operate a 125 cc motor scooter.
- Provide accurate, current, and complete information when registering.
- Are not currently disqualified from driving, on a Learner (L) permit only (Learner riders require supervision and cannot use a rental scooter), or otherwise legally restricted from riding a motorcycle in NSW.
We may verify your licence with the issuing authority and reserve the right to refuse service to anyone who fails verification or whose use of the Service we reasonably believe to be unsafe, fraudulent, or in breach of these Terms.
3. Your account
You are responsible for keeping your account credentials confidential. You must notify us immediately of any unauthorised access. We may suspend or terminate your account if we reasonably believe your account has been used in breach of these Terms or fraudulently.
You may close your account at any time via the in-app settings or by emailing hello@skootor.com. Closure does not extinguish charges owing for completed rides.
4. Booking & payment
Rentals are sold in three tiers:
- Daily: AUD $30 — covers a 24-hour rental window.
- Weekly: AUD $80 — covers a 7-day rental window.
- Monthly: AUD $250 — covers a 30-day rental window.
Rates are inclusive of GST. The rental tier is charged in full when the ride starts. The window begins at unlock and ends after the corresponding period, unless extended at the then-current rate.
Additional charges may apply for fuel below the start level (fuel surcharge), parking outside a designated return zone (return-zone fee), damage to the vehicle, late return, cleaning, traffic infringements incurred during your ride, or recovery of a scooter abandoned outside our operating area. The detailed fee schedule is in the Rental Agreement.
All payments are processed by Stripe. By providing your card, you authorise Skootor (via Stripe) to charge the upfront rental amount, plus any additional charges that arise during or after your ride.
5. Cancellation & refunds
Prepaid rides:we charge in full at unlock, and we do not offer refunds for unused time (e.g., if you return a daily rental after 4 hours, you still pay $30). This is the trade-off for the simple, no-meter, transparent flat-rate model.
Advance bookings (where supported): we hold a scooter for you for an upcoming window. Cancellation policy:
- More than 24 hours before start: full refund.
- Between 24 and 4 hours before start: 50% refund.
- Within 4 hours of start, or no-show: no refund.
Service failures:if a scooter is unrideable through no fault of yours (mechanical issue, won't start, etc.) and we cannot offer a replacement within 15 minutes, you'll receive a full refund and a credit for a future ride.
None of the above limits your rights under the Australian Consumer Law — see section 12.
6. Acceptable use
When using the Service, you must not:
- Allow anyone else to ride the scooter, including passengers.
- Ride under the influence of alcohol, drugs, or any medication that impairs operating ability.
- Ride on highways, motorways, or any road with a speed limit above 80 km/h.
- Ride off-road, on beaches, or in places not suitable for a road-registered scooter.
- Use the scooter for any commercial purpose (food delivery, courier work) without our written consent.
- Modify, tamper with, or attempt to disable the GPS tracker, immobiliser, locks, or any other on-board hardware.
- Try to reverse-engineer, scrape, or interfere with the Service or its software systems.
- Use the Service for any illegal activity, or in a way that breaches NSW road rules.
- Leave the scooter unsecured (engine off + alarm armed via End ride) when not in use.
- Resell, transfer, or sublease your account or your rental.
Breach of this section may result in immediate termination of your ride, suspension of your account, full liability for damages, and (where applicable) referral to law enforcement.
7. Vehicles & safety
All Skootors are road-registered 125 cc motor scooters, comprehensively insured under our fleet policy, and inspected on a maintenance schedule. Helmets are provided with every scooter under the seat.
You agree to inspect the scooter and helmet at the start of each ride, and to report any damage, missing equipment, or mechanical concern through the in-app help before riding. By starting the ride, you confirm you have inspected the scooter and that it appears in safe rideable condition.
You must wear the supplied helmet at all times while riding, with the chin strap fastened. You must comply with all NSW road rules. See our Safety & ride tips page for further guidance.
8. Insurance, liability & indemnity
Our insurance: the scooter carries compulsory third-party (CTP) personal-injury insurance under NSW law, plus a comprehensive fleet policy that covers damage to third-party property and to the scooter itself, subject to the excess and exclusions set out in the Rental Agreement.
Your liability: you are responsible for any excess on the comprehensive policy (up to a maximum stated in the Rental Agreement) for damage caused during your ride. You are fully liable for damage or loss caused by:
- Reckless or grossly negligent riding.
- Riding under the influence of alcohol or drugs.
- Riding without a valid licence.
- Allowing an unauthorised rider to use the scooter.
- Any other breach of these Terms or the Rental Agreement that voids the insurance cover.
Indemnity: to the extent permitted by law, you indemnify Skootor against all loss, damage, claims, and expenses (including legal costs) arising out of your use of the Service in breach of these Terms.
To the maximum extent permitted by law, Skootor's total liability to you for any claim arising from the Service is limited to the total fees you have paid us in the 12 months preceding the event giving rise to the claim. This cap does not apply to liability we cannot lawfully exclude (e.g., personal-injury claims subject to compulsory insurance, or claims under the non-excludable consumer guarantees in the ACL).
9. Traffic infringements & parking fines
Any traffic infringement, parking fine, toll, or speed-camera notice issued in respect of a Skootor while you were the renter is your responsibility. We will forward the notice to you and may pass on a processing fee of $[20] per notice. If the infringement is paid by us and reimbursed by you, we may recover it via your saved payment method.
10. Communications
By creating an account you consent to us sending you operational communications (ride receipts, safety alerts, account notices, security advisories) via SMS and email even if you have opted out of marketing. You can opt out of marketing communications at any time via the in-app settings.
11. Termination
We may suspend or terminate your account immediately if you breach these Terms, our Rental Agreement, or applicable law, or if we reasonably believe doing so is necessary to protect other riders, the public, or our service. We will refund unused prepaid fees where required, subject to any amounts you owe us. Termination does not affect liabilities accrued before termination.
12. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be lawfully excluded. Where we are permitted to limit our liability for a breach of a non-excludable guarantee, our liability is limited to re-supplying the service or refunding the price paid for it.
13. Governing law & disputes
These Terms are governed by the laws of New South Wales, Australia. You and Skootor each submit to the exclusive jurisdiction of the courts of NSW (and the Commonwealth courts sitting in NSW) for any dispute arising under these Terms, except that either party may seek urgent injunctive relief in any court of competent jurisdiction.
Before commencing proceedings, you agree to first contact us at hello@skootor.com and give us 30 days to resolve the dispute in good faith.
14. Changes to these Terms
We may update these Terms from time to time. The current version always lives at this URL. For material changes, we'll notify you by email or in-app at least 14 days before they take effect, and your continued use of the Service after that date constitutes acceptance. If you don't accept the change, you may close your account.
